Privacy Policy

This Privacy Policy was last modified and is effective as of January 12, 2017.

This Privacy Policy applies to information collected on or through the websites, mobile websites, social media sites, mobile applications or other digital platforms, and their contents, products and services (collectively, the “Digital Services”) to which it is posted. This Privacy Policy forms part of your legal agreement with Vision Source, LLC. and its affiliated entities (“Vision Source”, “we” or “us”) under the Terms of Use applicable to the Digital Services you are using. Please read this Privacy Policy carefully to be sure you understand how Vision Source collects and uses information and under what circumstances Vision Source shares information about you.

Portions of the Digital Services are intended for members of or applicants for membership in Vision Source’s Insight program for independent optometrists (“Insight”). Insight is intended for business purposes only, not for personal, household or consumer use. 1. Vision Source Can Modify This Privacy Policy

Vision Source reserves the right to modify this Privacy Policy at any time pursuant to the terms and conditions of the Terms of Use. Whenever this Privacy Policy is revised, we will update the “effective date” at the beginning of the Privacy Policy. In addition, we may, but are not obligated to, send you email notification of changes to this Privacy Policy. We encourage you to review this Privacy Policy each time you use the Digital Services to see if the Privacy Policy has been revised since your last visit and to remain aware of the terms and conditions that apply. Your continued use of the Digital Services after we have posted the revised Privacy Policy constitutes your agreement to be bound by the revised Privacy Policy.

2. Information Vision Source Collects

Information You Provide: We collect information that you voluntarily provide to us on or through the Digital Services. This information may include personally identifiable information (“PII”). Examples of PII that we may collect include your name, mailing address, email address, and telephone number. Additional information that may be collected from you on or through the Digital Services includes, but isn’t limited to:

  • If are entering a sweepstake, contest, giveaway or other promotion (each a “Promotion”), your age or birth date and any information necessary to complete the Promotion entry or fulfill prizes.
  • If you are participating in a survey, we may ask your gender and age, income, ethnicity, family size and marital status.
  • If you are sharing information from the Digital Services with a third party, the third party’s email address will be collected.
  • If you are using a service, information necessary to provide the service you have requested.
  • If you use the virtual fitting room feature, your image and email address may be collected. Please note that this information used by Fitting Box, a third-party vendor engaged by Vision Source to provide the virtual fitting room feature, and is subject to the Fitting Box legal disclosures provided on the virtual fitting room page. This information is not used by Vision Source.

Information Collected Automatically: Our Digital Services capture certain non-personal technical information automatically when you visit the Digital Services. This information may include your Internet protocol (IP) address, browser type and computer operating system, device type, application software, time and date you visit or use the Digital Services, and traffic patterns and usage data, such as the pages you access, the address of the website that directed you to the Digital Services or the website you visit when you leave the Digital Services.

Location Information: Vision Source does not currently use geolocation to collect information regarding your precise location. However, if you want to use our eyecare professional locator feature, we will ask you to provide information about your zip code, city and/or state. We may also derive approximate location information from your IP address.

3. Purposes of PII Collection

We request PII to provide a service, to provide information about Vision Source’s products or services, to complete a transaction, or to improve our products and services. Examples include:

  • to send you newsletters, special offers or other information we believe will be of interest to you;
  • to help you find an eyecare professional or doctor;
  • to provide information regarding vision, vision care and vision correction;
  • for surveys and other consumer research;
  • to respond to your questions or comments or otherwise provide you with customer service;
  • to provide the information, products and services you request;
  • to administer Promotions;
  • to personalize and improve your experience when using the Digital Services;
  • to improve our products, services and marketing;
  • for security purposes.

4. Insight Applicants and Members

Vision Source may collect additional information, including PII, from Insight members or applicants for Insight membership. This information may include, but isn’t limited to, information about your business, including business name, location, mailing address, email address, phone number, facsimile number, website URL, sales, revenues and expenses, and personnel, as well as your title or position. We may also collect financial and tax-related information, including your information related to your credit card and bank account.

The information collected is used to provide Insight membership services and benefits, to calculate and collect member royalties, to calculate and process rebates, for credit or fraud prevention purposes, for tax reporting purposes, and to administer and fulfill member Promotions.

5. Protection of Information Vision Source Collects

No website or server is completely secure and we cannot guarantee that your PII will not be accessed or misused by unauthorized third parties. Vision Source urges you to use caution when using the Internet. This includes not sharing your passwords.

6. Sharing of Information

Vision Source may disclose your information, excluding PII, to third parties. Vision Source will not sell, trade, or otherwise transfer to third parties your PII except as described below or unless Vision Source provides advance notice as described in the Terms of Use: Subsidiaries and Affiliates. Vision Source may transfer PII to its parent, subsidiaries and their corporate affiliates, including future subsidiaries and affiliates.

Consultants, Service Providers and Vendors. Vision Source may disclose PII to third party consultants, service providers and vendors (such as providers of hosting, support, maintenance and repair services, mail delivery services, evaluation data analysis, data cleansing, Promotion administration and fulfillment, advertising, marketing and promotional activities, fraud protection and risk reduction, and payment processing and authorization) to provide services to you or Vision Source.

Joint Promotion Partners. Sometimes we conduct joint Promotions with third parties. If you register for one of those joint Promotions your information may be collected by both Vision Source and the third party. Or, we may give you the option to have us share your information with the Promotion partner. Your information will be used by us and/or by them as described in our respective posted privacy policies.

Legal Compulsion/Enforcement of Rights/Security. Vision Source reserves the right to release PII (i) when Vision Source is under legal compulsion to do so (e.g. we have received a subpoena) or Vision Source otherwise believes that the law requires us to do so, (ii) when Vision Source believes it is necessary to protect and/or enforce the rights, property interests, or safety of Vision Source, our users or others, or (iii) as Vision Source deems necessary to resolve disputes, troubleshoot problems, prevent fraud and otherwise enforce the Privacy Policy and Terms of Use.

Reorganization or Sale of the Company. In the event that the Vision Source is merged with or becomes part of another organization, or in the event that Vision Source is sold or it sells all or substantially all of its assets or is otherwise reorganized, the PII Vision Source collects will be one of the transferred assets to the acquiring or reorganized entity.

Third-Party Marketing. Vision Source may share your PII with third parties for their marketing purposes.

As Otherwise Allowed by Law. Vision Source may transfer PII to third parties where we are expressly authorized by applicable law to do so.

Sharing by You. Please note that the Digital Services may allow you to share information, including PII. For example, the Digital Services may contain customer reviews, forums, message boards and/or other features (such as the VS Live section of Insight) that allow you to post or upload content. The Digital Services may also allow you to share information with third parties or with your social media accounts. Please remember that any information disclosed by you in this manner becomes public and you should exercise caution when considering the disclosure of your PII. You agree that Vision Source is not responsible for material shared by you or posted by you or others in our public forums.

7. Parents and Guardians

Our Digital Services are meant for adults. We do not knowingly collect personally identifiable information from children under 13 or knowingly permit minors to create an account. If you are a parent or legal guardian and think your child has given us information, you can contact us to remove the information.

8. Opt-Out Choices

Emails. You can opt out of receiving future promotional emails from Vision Source by following the unsubscribe procedures indicated in each email. Even if you opt out of receiving promotional emails from Vision Source, we will send you transaction emails and respond to questions from you. In addition, if you are an Insight member, you may indicate your notification preferences in the “settings” section of your Insight account.

Cookies. Vision Source uses cookies, which are small data files created by a Web server and stored by your browser, to keep track of and enhance certain user activities on our Digital Services. For example, we may use cookies to store certain user preferences. We may also use cookies to help you log into your accounts by remembering your username and password.

In addition, Vision Source uses analytics tools, including Google Analytics, that deliver cookies to your computer or mobile device when you visit the Digital Services. These analytics tools help us understand how visitors engage with the Digital Services. You may block or restrict cookies on your computer or device or purge them from your browser by adjusting your web browser preferences. You should consult the operating instructions that apply to your browser or your mobile device’s user guide for instructions on how to configure your setting to meet your preferences. Cookies allow you to take advantage of some features or functions of the Digital Services, so if you block or otherwise reject our cookies, you may not be able to use some features of the Digital Services.

Interest-Based or Behavioral Advertising. Vision Source may engage in interest based advertising (also known as behavioral or targeted advertising). Behavioral advertising uses technologies such as cookies and web beacons to collect information about your online activities over time and across third party websites and platforms, which may include mobile applications. This tracking allows advertisers to better manage advertising effectiveness and provide you with online advertisements more likely to be of interest to you. Please note that your opt-out choices may be device and/or browser specific. If you wish to opt-out from having analytics or interest-based information collected by participating entities across all devices and browsers, you need opt-out from each device and browser. Also, some third parties that use cookies to collect information may not participate in the industry-sponsored programs. You can best avoid third-party tracking in these circumstances through your browser settings and by clearing cookies.

Tools on Mobile Devices. You can control the tools on your mobile devices. For example, you can turn off the GPS locator or push notification on your phone. Please consult your mobile device’s user guide for instructions on clearing cookies, disabling location services, and disabling push notifications.

Do Not Track (“DNT”) Signals. Vision Source does not currently respond to DNT signals but may do so in the future.

9. Accessing and Updating your PII

You may contact us to update your PII. If you are an Insight member, you may update your PII by logging into your account and going to the appropriate section of your account.

10. Non-U.S. Residents

The Digital Services are intended only for residents of the United States. If you reside in a country other than the United States, you should not use the Digital Services.

11. Notice to California Residents - Your California Privacy Rights

Under California’s "Shine the Light" law, California residents who provide PII in obtaining products or services for personal, family, or household use are entitled to request and obtain from Vision Source once a calendar year information about the PII we shared, if any, with other businesses for their own direct marketing uses. If applicable, this information would include the categories of PII and the names and addresses of those businesses with which we shared customer information for the immediately prior calendar year (e.g., requests made in 2017 will receive information regarding 2016 sharing activities).

To obtain this information, please contact us, with "Request for California Privacy Information" on the subject line and in the body of your message. We will provide the requested information to you at your e-mail address in response.

Please be aware that not all information sharing is covered by the "Shine the Light" requirements and only information on covered sharing will be included in our response.

12. Links to Other Websites

The Digital Services may contain links to third party sites and digital platforms. For example, the VisionSource.com website contains a link to The Company Store (VisionSourceGear.com). However, The Company Store is owned and operated by a third party with Vision Source’s permission. In addition, the Insight section of the VisionSource.com website contains a link to the Vision Source Franchise Insurance Program, which is provided and operated by Arthur J. Gallagher & Co. Vision Source does not control and is not responsible for the foregoing sites or any other third-party site or platform to which the Digital Services link, including any products, services, content, policies or links you may find there. We encourage you to review the privacy policy, terms of use and other policies posted on each third party website and digital platform that you visit.
